When the surveyor or Amin comes or it can be said that when the government survey is conducted, it would be wrong to say that every landowner is staying on his land. Whoever is in possession is mentioned in the record in the way he is in possession. But, is everyone being taken into possession on the spot? - No. Because we can stay from our own district to another district due to work, or even from one country to another. Moreover, it is not that our land will be in only one district. Many people have land in their village houses and if their workplace is Dhaka-Chittagong, there is land in their name there too. Now, due to his inability to stay on any land, his land has been forgotten and registered in someone else's name during the land survey. It may also be the case that despite being in possession of the land, his land may be registered in someone else's name due to ignorance of the land. Again, there may be a discrepancy regarding the amount of land; your neighbor has a land next to your land, your land is 50 percent and your neighbor's land is 30 percent, but it turns out that while recording, 30 percent has been mistakenly recorded in your name and 50 percent in your neighbor's name or 40 percent in your name and 40 percent in your neighbor's name and the surveyor or amin has recorded it equally. In that case, how do you correct your land records? Since the Khatian and the design are prepared by recording on the spot, then the Khatian and the map will have errors in both places. Now you are at a loss, and you will face trouble in occupying the land. If you want to sell it, you will not be able to sell the entire land, you will have to sell what is recorded. You will have to face various complications. Now the question is, how can you re-record your land in your own name if it is recorded in your neighbor's name? In this case, let me first tell you that during the land survey, always try to be present in your own area when the survey is being conducted. If you are unable to be present yourself, you should have someone present, it can be your son/brother or you should assign someone to come along with your past documents and show them to the Amin or Surveyors during the survey work to get your land recorded correctly. Even then, let's assume that for some reason, your land record has been wrong in the past or present. In that case, the Surveyor or Amin, while recording, gives a slip, which is given to the landowner as a draft of the ledger, so that if there are any errors, they are given an opportunity to correct them within 30 days. If there are any errors in your land record, they will definitely correct them if they are correctable. Now, suppose that the 30-day period for you to go to the Settlement Office has passed. Your land is registered in someone else's name, now in this case, will you file a case in court?- Filing a case in court means a lot of time and costs of lawyers, your own travel expenses, a lot of expenses with the defendants, in that case, an easy way is, first try to reach an agreement with the person who is not the owner of the land but it was mistakenly registered in his name. If he is a good person, thinking about the afterlife, then he will definitely admit that he is not the owner of the said land, you are the owner of that land, in that case if he agrees, I will return your land to you. In that case, without wasting time, money, effort, you can file a case in court and get the owner from this person in the original form, in this way, he will sell the land that was mistakenly registered in his name to you. By making this clear deed, you can get back the ownership of your land. Which is possible within a day. Now the point is, you have repurchased your land from him on the basis of the document, it is much like repurchasing your own land; but the actual fact is that you are repurchasing your own lost land. Now there are some registry costs here which are the highest in the case of clearing, but if you calculate it, it will be much less than the cost of rectification through a court case and you will save time. You can get the document from the sub-registry office if you want, but then the important thing for you is to get the document registered in your name at the land office. Keep in mind that when the government records it, that person's name appears in the government ledger. Now since that person is the owner, since you have brought the ownership back to you by documenting it, now if you submit a copy of that document and register your name, that person's name will be removed from the government ledger and it will be recorded in your name again.
