How Important is It for Buying and Selling a Home? | Guru Living Hello everyone, today I'd like to discuss another important topic for those planning to buy or sell a second-hand home. When we buy or sell a home, there's an important document involved: the "Purchase and Sale Agreement." What is a Purchase and Sale Agreement? A purchase and sale agreement is a contract that expresses our intention to sell the house, and the buyer to purchase the house. This document is legally binding. If either party fails to comply with the agreement, either party can sue. It's like this. It's crucial to specify everything in detail in the agreement, including the price, the deposit amount, who will pay the expenses, the time period, and other conditions. These are crucial to avoid any problems during the sale. Let me elaborate on this further. The main components of a purchase and sale agreement are as follows: Seller's information: First name, last name, address, and ID card number. The first part of the document contains information from both parties. In the contract, the legal terms used for the buyer and seller are: Buyer = Buyer, Seller = Seller. This first part of the document is very important and should be carefully reviewed. Details of the Property to be Sold The second part is the details of the property to be sold. This information must be accurate, such as the title deed number, area, building type (detached house or condominium), and the location as per the house registration. All of these must be verified. Sales Price + Deposit This section specifies the price you will sell and agree to sell at. The contract also includes a deposit. Typically, the deposit starts at 5-10%, depending on the agreement. This deposit is used to prevent breach of contract or other obligations. Transfer Fees This is a very important part for both the buyer and seller. When transferring ownership of a house, land, or condo at the Land Department, there are expenses that will be incurred. These include: Transfer Fee, Mortgage Registration Fee, and Stamp Duty. Specific business tax and income tax, which I've already made a video explaining in detail on. You can watch it here. But the sales contract specifies who is responsible for all the expenses mentioned above: the buyer or the seller. So, we need to carefully check this. Delivery period The transfer period is the agreed upon timeframe between the buyer and seller. We will complete the transfer of the house within this period. Normally, this period is 1 month, but not more than 2 months. The reason for specifying this timeframe is to protect the seller's interests by preventing the time from being extended too long, potentially causing a loss of sales opportunities. Other conditions in the contract Other conditions in the contract include additional details, such as what is included in the house, what condition the condo unit is in, which furniture is included and which is not included. The seller can specify these details for the buyer. Conditions for breach of contract This is another important part that must be clearly stated. Both the buyer and the seller will be liable for a fine if the contract is breached. The buyer may forfeit the deposit provided in the contract if the terms are violated, such as failure to transfer the property. If you change your mind or whatever, as a buyer, if the seller breaches the contract, we can sue the seller and take legal action against them for breaching the contract. The details of the damage claims should be included in the contract. Sign and certify every page and end of the contract, both buyer and seller. The final thing that must be on every page is a signed certifying document, whether you're the buyer or seller. If I were to recommend it, I'd say you should sign every page of the contract to ensure it's legally binding for both buyer and seller. A sales contract should be made in two copies: one for the buyer and one for the seller. These are all very important details in a sales contract. So, let me summarize for you all. If you're selling a home or buying a second-hand home, you should thoroughly study the sales contract. Every time you buy or sell a home or condo, you need to read the details in detail. Failure to do so could lead to unnecessary expenses or even tricks that could result in losing your deposit. So, I insist that you read it thoroughly before placing a deposit and before signing the contract. However, for those who buy or sell a second-hand home through a real estate agent, they will usually have a pre-arranged sales contract prepared for you.
