These principles reflect the essential values ​​for justice in the workplace and are applied both in the development and enforcement of labor laws. Today we will examine the main principles governing Labor Law and their importance for fairer employment relationships. The principle of protection is considered the cornerstone of Labor Law. It arises from the need to balance the relationship between employee and employer, recognizing the vulnerability of the worker to the employer. This principle is divided into three sub-principles: in dubio pro operario, the most favorable norm, and the most beneficial condition. The Principle of Non-Waiver of Rights determines that workers cannot waive their rights (they cannot give up labor rights), even if they claim it is of their own free will. According to the Principle of Continuity, employment contracts are generally for an indefinite period, prioritizing, whenever possible, the permanence of the employment relationship. According to the principle of the primacy of reality, in cases of discrepancy between what is formalized (on paper) and what actually happened, the reality of the facts must prevail.
