Through a defense, the defendant will have the opportunity to defend himself and present his version of the story. Today I will explain what a contestation is, in a very easy to understand explanation. A civil lawsuit begins with an initial petition, which is filed by the plaintiff. The civil process begins with the initial petition, which is the moment in which the author presents his requests and states what his rights are (or, at least, the rights he believes he has). After that, the judge will order the citation, so that the defendant can participate in a conciliation hearing with the plaintiff. The preference is that, whenever possible, there is a conciliation, an agreement between the plaintiff and the defendant, so that the action ends more quickly, without having to go through the entire process. But let's imagine there is no agreement. In this case, if there is no agreement, the defendant may file a defense. As a rule, the deadline for filing a response in civil proceedings is 15 working days. The defense is the procedural act in which the defendant can present arguments to defend himself against the plaintiff's requests. The defendant may also attach documents proving his allegations or specify evidence he intends to produce. In the defense, the defendant must refute the facts alleged by the plaintiff. If the defendant does not refute any fact, it will be considered true. In other words: it is very important that the lawyer is careful when filing the objection, so as not to miss anything. After the response, in some cases the judge may request that the plaintiff submit a reply, to comment on the defendant's arguments. The order is then this: initial petition - response - reply (when reply is applicable).
