There are always discussions and arguments about whether buyers really have to pay the real estate agent. A real estate agent's commission increases the already high additional purchase costs – and many buyers believe that the real estate agent "didn't do anything except unlock the door." In many cases, this isn't quite true, but there is a relatively new Federal Court of Justice ruling that clarifies the cases in which buyers can refuse to pay the real estate agent's commission. The property transfer tax and notary fees alone, which together range between 8% and 8.5% depending on the federal state, add up to large sums that usually have to be paid from equity and are thus irretrievably lost. Added to this is often the broker's commission, which further increases the additional purchase costs. Many buyers then ask themselves: "Do I really have to pay the broker's commission?" "I didn't hire him, and he or she didn't do much for me." It's no coincidence that there are so many legal disputes on this topic. I recently came across a ruling by the Federal Court of Justice (BGH) that contains statements about the cases in which buyers are not required to pay a broker's commission, and I present the ruling in the video. But first, I'll give a brief overview of the legal basis for brokerage fees according to Sections 656c (dual activity as a broker) and 656d of the German Civil Code (BGB), which, however, only apply to consumers. Since the end of 2020, a consumer generally only has to pay half of the total brokerage fee when purchasing a single-family home or condominium. Sales of building plots or multi-family homes are not subject to this regulation. Sales to commercial buyers in general are also not subject to this provision, even if they are not single-family homes or condominiums. In the case at issue in the Federal Court of Justice ruling of March 21, 2024, the broker acted for both parties, brokered a semi-detached house, and demanded the buyer's share of the commission. The buyer, a consumer, refused to pay until the brokerage agreement between the seller and the broker was presented to him so he could verify whether a commission of the same amount had been agreed upon with the seller. However, the broker refused to disclose the commission agreement. Ultimately, the legal dispute ended up before the Federal Court of Justice; you can find out the outcome in the video.
