Under Article 67 of the Constitution, ONLY the National Land Commission @NLC_Kenya has the mandate to alienate public land for housing projects. The Cabinet Secretary for Lands does NOT have the legal power to do this unilaterally. 4Furthermore, Article 10 makes Public Participation mandatory for NLC to conduct public participation before even the commencement of building of this houses. Now, if you are a resident of Mathare, Kapsabet, Kerugoya, or Nakuru or any other place in Kenya where this illegal construction is taking place, and the NLC never held public forums in your village to clear this land for housing, the entire project sits on a legally defective foundation. 5Look at the Supreme Court ruling in Torino Enterprises Ltd v. AG (2023). The court ruled that if land was already reserved for a public body like it was in this case where the land had been reserved to the DoD, a ministry, department or a parastatal, that land it is therefore NOT available for allocation to anyone else. Any title issued over it is void. 6The Torino case also killed the "innocent buyer" excuse. The Supreme Court held that buyers MUST conduct rigorous physical due diligence. If the land was previously stolen public utility land or allocated to any of government’s ministries, departments, and/or parastatals, you cannot claim ignorance. The law will not protect your 3M. 7The Bottom Line: Do not rely solely on government marketing. Before paying your milestone balances, do your due diligence: demand to see the official NLC Gazette notice, visit the lands office and get to know whether the land on which the house your intending to purchase had been allocated to any government department, investigate on how the ministry of Land and Housing allegedly got it back for purposes of constructing this Boma Yangu scam, find out whether at the time the Ministry of Housing was getting this land back conducted the mandatory public participation, get the minutes for that public participation for your specific site.
