Let's understand the differences between them, how they are applied and their importance in the legal system. What are Mandatory Norms? Mandatory rules, also known as imperative rules, are those that must be observed by everyone and do not have much “flexibility” in their application. They do not allow the parties involved to make agreements that contravene their provisions. Mandatory rules are public order rules and are non-negotiable in nature. Mandatory rules are essential to guarantee public order, legal certainty and the protection of fundamental rights. And what are Dispositive Rules? Dispositive rules, unlike mandatory rules, are those that allow the parties involved to make agreements (negotiations). Dispositive rules are more flexible. Dispositive rules give more autonomy to the parties, so that they can adjust agreements and contracts to their specific needs.
