Works councils often grapple with the question of whether they are allowed, or even required, to hear from affected employees during the consultation process before dismissals. The answer can be found in Section 102, Paragraph 2, Sentence 4 of the German Works Constitution Act (BetrVG). It states: "The works council shall, insofar as this appears necessary, hear from the employee concerned before issuing its statement." Even if the works council then has to deliver bad news...
