The Supreme Court has ruled against the general practice of allowing public employees who have suffered an abusive chain of temporary contracts to become permanent without having passed a competitive selection process. In a ruling made public this Tuesday, the full Social Chamber maintains that permitting such conversion would violate the constitutional principles of equality, merit, and ability, as well as prevent other citizens from accessing public employment. “Temporary contracts (…) without passing a public employment access procedure (…) do not allow these workers to acquire permanent status,” the ruling states. However, the high court does allow for conversion to permanent status in a very specific case: that of workers who have participated in a competitive examination or a combined competitive examination and merit-based assessment with eliminatory tests, have demonstrated their qualifications, and yet have not obtained a position due to a lack of vacancies, subsequently continuing with abusive temporary contracts. This excludes employees who gained access through merit-based competitions, job pools, or other processes without eliminatory tests. The ruling is in line with the decision of the Court of Justice of the European Union of April 14, which questioned whether Spanish legislation adequately penalizes the abuse of temporary employment in the public sector. In response to this criticism, the Supreme Court considers that the appropriate measures include the payment of compensation and referring the case to the Labor Inspectorate to initiate sanctioning procedures. The Government, for its part, interprets the ruling as a ratification of the doctrine already established by the court itself and aligned with the criteria of the Constitutional Court.
