REQUIREMENTS FOR EXPUNGING CRIMINAL RECORDS Many people mistakenly believe that serving the sentence means having a criminal record is no longer an issue, but this is not the case. The fact that we have served our sentence does not mean that from that moment on we no longer have a criminal record. What we have, at most, is the completed sentence. However, to obtain its cancellation from the Ministry of Justice, we must meet certain requirements outlined in Article 136 of the Penal Code, which are: 1. Having paid the civil liabilities arising from the offense, unless we have been declared insolvent. 2. And having passed without committing another crime for a period of time that varies depending on the sentence imposed.
