The political future of Mbeere North Member of Parliament Leo Wamuthende continues to hang in the balance as the courts inch closer to a final determination on the validity of his election victory. What began as a straightforward by-election declaration has since morphed into a prolonged and closely watched legal saga that has gripped residents of the constituency and political observers across Kenya. Wamuthende was declared the winner of the Mbeere North parliamentary by-election, held on November 27, 2025, with 15,802 votes, narrowly defeating his closest rival, Newton Kariuki Ndwiga of the Democratic Party, who garnered 15,308 votes. The razor-thin margin of just 494 votes set the stage for the legal battles that followed. Two separate petitions were filed challenging the results. The first was brought by voters Julieta Karigi Kithumbu and Patrick Gitonga Gichoni, who sought the nullification of Wamuthende's win. However, the Embu High Court struck out their petition after finding that they had failed to comply with the constitutional requirement to deposit Ksh 500,000 as security for costs at the time of filing. The court ordered the two petitioners to jointly pay Ksh 800,000 in legal costs, a ruling that drew sharp debate about access to electoral justice. Kariuki's lawyer criticized the high cost of filing election petitions, arguing that the security-for-costs requirement is punitive to ordinary citizens who want to seek electoral justice, and called on Parliament to review the provision. On the other side, Wamuthende's counsel, Adrian Kimotho, defended the strict application of the law, warning that lowering the threshold could encourage frivolous cases rushed to court without merit. The second and more substantive petition, filed by Democratic Party candidate Newton Kariuki Ndwiga, survived the preliminary stage and proceeded to a full hearing. In his petition, Ndwiga argued that the by-election was riddled with chaos, violence, manipulation of voter registers, and altered election documents. The hearing was marked by sharp exchanges, concluding with MP Wamuthende declining to take the witness stand for cross-examination and opting instead to rely on his sworn affidavit, a move that drew immediate objection from the petitioner. In a significant development, the Embu High Court ordered a limited scrutiny and recount of ballots from specific polling stations where irregularities were noted. Justice Richard Mwongo directed the Deputy Registrar to open ballot boxes and scrutinize election materials at multiple polling stations, including Gitiburi 1 and 2, Kaungu, Siakago Social Hall, Mwondu Primary School, and Gikuyari Primary School, citing violence, a broken chain of custody, and irregularities in the voter register. Among the dramatic events highlighted in court was a fire that broke out at Gitiburi 2 polling station when a gas lamp exploded, forcing IEBC officials to relocate ballot boxes to a waiting motor vehicle.
