You maybe in a position where you have filed an RTI Application but not received a reply for the same or are not satisfied by the reply. For that purposes as well the RTI Act puts down mechanism to tackle such situations. The RTI Act, 2005 sets forth guidelines and procedures for applicants who have not been given the information they seek in time or are not satisfied with the information provided to them. An individual for the very same can go through a chain of appeals after the initial time period of 30 days to be supplied with an answer lapses. The RTI Act, 2005 also makes provision that if an applicant gives an application to an Assistant CPIO or the wrong public authority, 5 days are added to the generally prescribed time frame. If an applicant is not satisfied with the response received or does not get a response at all or in the prescribed time frame then an individual should file an appeal with the relevant first appellate authority within 30 days of the expiry of the 30 day time period to supply information. Such an appeal will be reviewed and disposed off within 30 days of receipt, or 45 days in exceptional circumstances. If the appeal is still not disposed off or if you are still unsatisfied, one can file a second appeal to Central Information Commission. this appeal must be done away within 90 days from the date of the last day of the 30 or 45 day time period of the first appeal. Getting the information that you have asked for is your right and by way of the RTI Act it has been made sure that the information so asked for is provided to an applicant. Even if the asked for information is not provided within the stipulated time frame then a series of appeals have also been put into place to make sure the information so asked for is provided.
