A land purchase resulted in a years-long legal battle. An Aktobe resident contacted our editorial team, claiming that he purchased a plot of land two and a half years ago, built a house on it, and later unexpectedly discovered that the land had been seized before the transaction. Now, even through the courts, he can't register the land in his name. Maksot Makhambetov recounted how he purchased a plot of land in December 2023. After the purchase, he began building a house, investing a significant amount. However, some time later, it was discovered that the plot had been seized as early as 2022 as part of enforcement proceedings. According to Maksot, the previous owner had outstanding debts to the bank, and he himself was unaware of the existing restrictions. Maksot Makhambetov, Aktobe resident: "The transaction was officially completed through a notary and mediation, so I had no doubts. I started building a house, investing all my savings. And then it turned out that the land had been under foreclosure since 2022. It was a real shock for me, because no one warned me about it. I believe the notary should have discovered this." Today, the man finds himself in a difficult situation. The house has already been built, but he cannot register the land in his name. According to him, the foreclosure makes it impossible to register his ownership. Maksot claims that he has already appealed to the court three times, but has not yet been able to resolve the issue. Maksot Makhambetov, a resident of Aktobe: "Now I can't register the land in my name, even though the house has already been built. I've appealed to the court three times, but the issue still hasn't been resolved. The court ordered a purchase and sale agreement, but the Justice Department can't register it, saying the land is under foreclosure. And so it goes on and on. I don't want someone else's property—I just want my issue resolved according to the law." At the same time, lawyers note that such situations require detailed study. If the property was already under arrest at the time of the transaction, the legal consequences depend on the specific restrictions imposed and whether the transaction complied with legal requirements.
