These are the most serious crimes, while a complaint allows for less serious crimes to be prosecuted. 👉 What both a complaint and a complaint have in common is that, once formalized before the Judicial Authority, they require the Public Prosecutor's Office to register the crime in the appropriate general register, identify the alleged perpetrator, and identify him or her. 👉 Upon identification, the Judicial Police acquire the personal details of the person identified as the alleged perpetrator of the crime, inform them of their right to appoint a lawyer of their choice, and, if they do not have one, a public defender will be assigned. They will also ask them to declare or elect an address for service of judicial documents. At that point, the person in question will learn that they are under investigation in a criminal proceeding. 👉 It may also happen that the perpetrator is not even identified, but the Public Prosecutor's Office will conduct the preliminary investigation, gathering useful information to ascertain the facts and, at the end, notifying the suspect of the conclusion of the preliminary investigation. Upon delivery of this document, the suspect becomes aware of their being under investigation and the reason why the Prosecutor's Office has decided to investigate them. 👉 What happens, however, if you suspect someone has filed a complaint against you, or the Judicial Authority has reported you for an act that may have violated criminal law? Can you take action on your own to find out if your name is actually registered in the register of suspects? Or do you have to wait for the Judicial Police to summon you to the barracks or police headquarters for identification? 👉 It is possible to find out if you are under investigation in a criminal proceeding by submitting a request, which your lawyer can formalize and which must be sent to the Public Prosecutor's Office. This request is informally referred to as "request 335," where 335 is the number of the article in the Code of Criminal Procedure that provides that the person under investigation has the right to know the entries against him/her in the special register kept by the Public Prosecutor's Office. These entries are communicated to the person to whom the crime is attributed, to the injured party, and to their respective lawyers, upon request. 👉 Therefore, the person to whom the crime has been attributed, the victim of the crime, and their respective attorneys can request a "certificate pursuant to Article 335 of the Italian Code of Criminal Procedure." If the person is not under investigation, the statement "no registration subject to communication" will appear.
