A sales representative is an employee whose role is to visit a specific clientele to collect purchase orders on behalf of their employer. Enjoying a specific status, the sales representative is a unique type of employee, as they have a certain degree of autonomy in conducting their business. The sales representative's compensation generally consists of commissions on orders, direct or indirect, placed with their employer through their efforts. This compensation may be a fixed amount, possibly supplemented by a variable component. Even without an exclusivity clause, the sales representative cannot represent competing companies or products without their employer's consent. Termination of a sales representative contract is subject to a notice period, the length of which varies. It is one month after the sales representative has been with the company for one year, two months after two years, and three months thereafter. In the event of termination of the employment contract of the sales representative, due to the employer, and in the absence of serious misconduct, accident or illness of the sales representative resulting in total incapacity for work, the sales representative shall be entitled to compensation for loss of clientele intended to compensate him for the damage suffered, due to the loss he has caused to his employer, which he has created, or which he has developed.
