Today, I present a new decision, this time from the Court of Justice of Bahia, reaching the same conclusion: when the focus of the lawsuit is on the embezzlement from the account, the bank's responsibility, and the correct distribution of the burden of proof, the scenario changes completely. The big mistake in many lawsuits is discussing only monetary correction indices. The central issue, however, is another: whoever managed the account needs to explain where the money went. ⚖️ In this ruling, the magistrate recognized that Banco do Brasil failed to prove the regularity of the PASEP account transactions and ordered the institution to reimburse the amounts, plus compensation for moral damages. Each case has its particularities, and no one serious promises results.
