The Comptroller General's Office resolved the appeals against the awarding of the ICE 5G project, but failed to thoroughly analyze one of the central issues in the case: whether the price improvement submitted by Ericsson respected the limit on the profit originally offered. According to the appeal, Ericsson offered a discount of approximately US$57.8 million, even though its declared profit was around US$29.4 million, a difference of US$28.4 million that the appellants consider contrary to the rules governing price improvements. The Comptroller General's Office itself has maintained in previous rulings that price improvements cannot exceed the profit originally offered. However, this issue was not analyzed in depth in this ruling. The ICE 5G project will define a significant portion of the country's technological infrastructure for years to come. Therefore, regardless of who is ultimately awarded the contract, the discussion revolves around one question: were the same rules applied equally to all bidders?
