The tenant of a commercial lease has broader rights. The aim is to allow them to develop their clientele and ensure a certain level of stability. This is referred to as commercial property rights. However, the tenant-manager must be vigilant. Indeed, the commercial lease agreement includes specific provisions. These provisions notably concern the conditions for setting and revising the rent amount. The owner and the tenant are free to set the rent amount. However, its revision depends on the provisions of the lease agreement. If the contract includes an annual indexation clause, the revision will occur every year. However, the revision can also be triennial and occur after three years at the request of either party. Take the time to read and negotiate your contract carefully! These rules apply for nine years and are linked to rent caps indexed to official indices. If no action is taken after nine years of the lease, the contract is automatically renewed. This is where particular attention is required! Indeed, after twelve years, the rent is completely uncapped. The tenant-manager must be vigilant as this nine-year deadline approaches. To ensure the lease is renewed and the rent remains capped, the tenant-manager must request renewal through a bailiff's notice.
