Ministers André Mendonça and Flávio Dino clashed on Thursday (11), during a session of the Supreme Federal Court (STF). The debate took place during the judgment of appeals concerning the thesis that redefined the civil liability of digital platforms for content published by users. Mendonça argued that the current model may generate an "inhibiting effect" on the free expression of society, by outsourcing and transferring to companies the initial judgment of illegality. In contrast, Dino contested the assessment, stating that, in practice, he does not observe such inhibition on social networks and pointed out the recurrence of criminal conduct in virtual environments.
