Today I will talk about custodial sentences, and I will talk about the types of sentences (imprisonment, detention and simple imprisonment), I will talk about the regimes of serving sentences (closed, semi-open and open), the rules regarding custodial sentences and how the progression of regime works. Before anything else, it is necessary to arrive at the sentence - how many years the convicted person will be sentenced to serve. This calculation is made by the judge through the sentencing (which is done in three phases, or three stages). After the judge calculates the sentence of the convicted person, it will be necessary to establish the initial regime of serving the sentence. Brazil has three different regimes of serving sentences: closed, semi-open and open. And what are the types of custodial sentences? We have imprisonment, detention and simple imprisonment. Imprisonment is applied to more serious crimes and it allows serving in a closed, semi-open or open regime. Meanwhile, the Detention penalty is intended for crimes considered less serious than imprisonment, and may be served in a semi-open or open regime, but not in a closed regime. Finally, the simple prison sentence is reserved for criminal offenses associated with misdemeanors, such as disturbing the peace or illegal gambling.
