The participation of two individuals can be understood as the criminal offense committed by more than one individual. Today we will understand what the participation of two individuals is - how it is characterized, the forms of participation and also its legal consequences. Concept of the participation of persons The participation of persons, also known as co-authorship or criminal participation, occurs when two or more people join together to commit a crime. We can have unisubjective and multisubjective crimes. Requirements for the participation of persons For the participation of persons to occur, the presence of four essential elements is necessary: Plurality of Agents: More than one person must participate in the execution of the crime. Unity of Crime: All agents must be committing the same criminal offense. Causal Relevance: The contribution of each participant must be relevant to the commission of the crime. Subjective Link (Psychological Bond): There must be an agreement of wills, even if tacit, between the agents. Types of Personnel Contest In personnel contest, participants may have different roles: Co-authorship: All participants have a direct and effective role in the execution of the crime. They share the same criminal intent and perform actions that directly contribute to the final result. Everyone has equal responsibility for the crime. Participation: The individual contributes indirectly to the execution of the crime. The participant does not execute the main act, but provides support. Participation can be of two types: Material Participation: The participant provides material means for the execution of the crime, such as weapons, vehicles or tools. Moral Participation: The participant instigates, encourages or morally assists the perpetrator of the crime, without being directly involved in the execution. Legal Consequences of Personnel Contest The perpetrators and participants are liable for the same crime, however, each one according to their culpability, considering the relevance of each one's contribution to the crime. Even in the case of a contest of persons, exclusions of illegality and guilt may be applied to certain participants, provided that the occurrence of these circumstances is proven.
