누수로 인한 피해, 어떻게보상 받나?

Q. Water leaks in apartments have recently become a major social issue, making headlines. Why does this happen? A. The media has been reporting daily on the damage residents suffer from water leaks in apartments, their causes, and countermeasures. The root causes can be attributed to "poor construction," "aging," and "misuse and maintenance." In newer apartments, poor construction, often due to inadequate waterproofing, is the primary cause. In older apartments, natural cracks due to aging or damage to the waterproofing layer caused by improper use or maintenance are the primary causes. Q. What damage can water leaks cause in apartments? A. When water leaks occur on the upper floor, the ceiling, walls, and floors of the lower floors typically become wet, causing mold and corrosion. This can also damage household items like electronics, bookshelves, books, clothing, and furniture, rendering them unusable. This can involve repainting the ceiling and walls, replacing the flooring, and repairing or replacing damaged household items. Temporarily vacating your home for this type of construction can incur hotel costs. Beyond repair and replacement costs, there are also costs associated with detecting defects and, if a lawsuit is filed, legal fees such as attorney's fees, stamp duty, delivery fees, and appraisal fees. Furthermore, the water leak can wreak havoc on your living space, and the psychological stress of having to live off-site during construction can be immense. Q. I heard there's a specific timeframe for holding the construction company accountable if the leak is caused by poor construction rather than the fault of the residents. Is that true? A. For apartments completed within five years (since the occupancy inspection), the "construction company" is generally responsible for repairing water leaks. If the leak is due to a design flaw, the designer may be held liable, but such cases are extremely rare. Regarding the defect warranty period of the project owner (construction company), Article 36 of the Apartment Management Act and Article 36, Appendix 4 of the Enforcement Decree stipulate that repair claims must be filed within a five-year period for defects in "roofing (gutter and rainwater pipe construction) and waterproofing" that may cause water leakage; three years for defects in "insulation, plumbing, wiring, window construction, water supply and drainage construction, heating, cooling, ventilation, and air conditioning system construction"; and two years for defects in "finishing construction (plastering, watering, painting, wallpapering, tiling, etc.)". Failure to do so triggers a statute of limitations, preventing further claims. Therefore, please be aware that for defects in exclusive use areas, the period is calculated "from the date the occupants move in," not from the date of the occupancy inspection (completion date). Q. So, how do I file a repair claim with the construction company? A. If you discover a defect, take photos or videos, write a letter requesting repairs, and send it directly to the construction company via certified mail. Or, ask the management office to file a repair request on your behalf. If the above-mentioned defect warranty period remains, the tenant representative council will typically investigate the defects in both the apartment's exclusive and common areas within the warranty period and request repairs on behalf of the residents. Your cooperation is highly recommended. To request repairs from the construction company, you must prove that the leak was caused by construction negligence. First, attach the waterproofing company's opinion to the repair request. If the construction company refuses or is insincere in its repairs, you will ultimately have no choice but to file a court appraisal to determine the cause and receive compensation for the repair costs. Q. Does the construction company perform repairs effectively? A. In my experience, construction companies rarely proactively repair defects to a level that satisfies residents. In most cases, they simply patch things up and then demand the return of the deposited repair deposit. In other words, since they've sold the apartment, they're taking what they want and ignoring after-sales service. So, the residents who purchased the apartment are forced to file a lawsuit through the Residents' Representative Council, claiming damages in lieu of repairs, and receive the judgment to repair the defects. Q. If a leak occurs after the construction company's warranty period has expired, who should be held responsible? A. As mentioned above, you can file a claim for repairs against the apartment construction company under the Apartment Management Act, claiming warranty liability for defects. If the construction company fails to perform properly, you can file a claim for damages in lieu of repairs.
