Arbitration practitioners have been watching the Aroma case with interest on the issue of the arbitrator's duty to disclose - when it arises and what is required. The Ontario Court of Appeal has taken a unique approach to this issue, which is not consistent with international standards and does not offer the clarity hoped. The Supreme Court of Canada denied leave to appeal the decision in July 2025.
