Justice Sameer Jain's single bench upheld the government's action against unauthorized constructions, ruling that the demolition and enforcement measures were legally justified. The High Court directed the formation of a committee comprising District Collectors, Superintendents of Police (SPs), and representatives of the Border Security Force (BSF) from the concerned border districts to identify, examine, and ensure the prompt removal of illegal constructions. The Court observed that: National security is paramount in border regions. Government authority in matters related to border security cannot be compromised. Relief cannot be granted merely on the ground that notice was allegedly not served. The alleged encroachers had already been given adequate opportunity to present their case. The Court dismissed all petitions, holding them to be without merit. Representing the Union Government, Additional Solicitor General Bharat Vyas argued that the petitions were premature and unfounded, stating that the matter involved unauthorized constructions on government land in sensitive border areas where national security must remain the highest priority.
