Indeed, several rabbinic legal analyses maintain that, according to the Israelite law of the time, David did not formally commit the sins attributed to him in a literal reading of the biblical text. First, concerning Bathsheba, the Talmud states that David's soldiers generally gave their wives a get (a conditional divorce document) before going on military campaigns. This practice aimed to prevent a woman from becoming an agunah ("chained woman"), that is, unable to remarry if her husband disappeared without his death being definitively established. According to this interpretation, Bathsheba was therefore not legally married to Uriah when David married her. The accusation of adultery, which presupposes a married woman, could not therefore be upheld in the strict sense of the law. Second, the rabbis emphasize that Uriah the Hittite was guilty of an act of rebellion against royal authority. When David ordered him to return home, Uriah refused to obey and declared that he would not enjoy the comforts of his home while the army of Israel was at war. Some interpretations consider this refusal to be an act of disobedience to a direct order from the king, falling under the status of mored bemalkhout ("rebel against the king"). In Jewish legal tradition, a king possesses special power to punish, or even execute, a subject guilty of such rebellion. Therefore, Uriah's death would not necessarily be considered murder under royal law. Thirdly, if Bathsheba was indeed divorced at the time, nothing legally prevented David from marrying her. David's future marriage to Bathsheba after Uriah's death is, moreover, presented in the biblical narrative as legally valid, and their descendants would be fully recognized within the Davidic dynasty. These arguments seem quite strange to me, for one simple reason. If Uriah was no longer legally married to Bathsheba, the get having taken effect, how could David legitimately ask him to return to his non-wife? Kind regards, JJJ.
