Georgia Agent as Landlord + Investor | Broker Answers FAQ
What disclosures are required when the landlord holds a Georgia real estate license? Derek Varnadoe is a licensed Georgia real estate broker and the VP of Broker Services at Solid Source Real Estate Companies. He discusses state disclosure requirements and how to best handle buying and selling real property "subject to" an existing lease agreement. Most community associations have restrictions on renting. How can buyers protect themselves when placing offers to purchase? Derek shares ideas on how the offer can be structured to disclose and protect the buyer's interest (special stipulations). Georgia's common landlord-tenant law requires a 60 day notice from landlord to tenant when a landlord is terminating occupancy; however, the terms of the written lease would prevail. Common law only requires a 30 day notice from tenant to landlord when a tenant is planning to vacate. Again, the lease agreement should be carefully reviewed and would prevail. When a buyer purchases a property that is leased, the buyer inherits the lease (and tenant) upon closing. For this reason, buyers are strongly encouraged to review the terms of the lease and perform their own due diligence. Derek also discusses advertising and how agents can stay out of trouble when promoting their own property.
