Ebony Parker, the former assistant principal at Richneck Elementary School in Newport News, Virginia, was facing 8 felony child abuse and neglect charges tied to the 2023 shooting of first grade teacher Abby Zwerner by a 6-year-old student. During this trial, prosecutors argued that Parker ignored multiple warnings that the student may have had a gun before the shooting happened inside Zwerner’s classroom. Witnesses testified that school staff reported concerns about a weapon, searched the student’s backpack, requested permission to search his person, and raised concerns to administration before the gun was ultimately used to shoot Abby Zwerner. The prosecution’s theory centered on whether Dr. Ebony Parker’s actions — or failures to act — amounted to felony child abuse with reckless disregard for human life under Virginia law. Prosecutors charged Parker with 8 separate felony counts, allegedly tied to the 8 bullets initially loaded inside the firearm. But after the prosecution rested its case, the defense made a motion for judgment of acquittal arguing that even taking the evidence in the light most favorable to the state, prosecutors had failed to legally prove the charges. In a shocking turn, the judge agreed and dismissed the charges before the case could even go to the jury.
