What is the Meaning of the Hypothetical Questions Your Judge Asks the Vocational Expert
Is it possible to figure out what your judge is thinking by analyzing the hypothetical questions that the judge asks the vocational witness at your hearing. Most Social Security disability judges use vocational expert witnesses to understand how your medical issues might impact your work capacity. Judges are not experts about jobs in the national economy so they rely on experts who have years of experience with job placement and job duties. However, as I point out in this video, you can assume that your judge probably knows what a #vocationalwitness will say in response to a particular question as a practical matter the judge uses these hypothetical questions to support the conclusions the judge has already reached. What you want to hear from the vocational witness are answers that include the words “I cannot identify any jobs that would fit withing the limitations set out in your hypothetical question.” If the judge adopts that question, he/she will conclude that your medical issues are too severe to allow for competitive work and you will be found disabled. Conversely, if the judge’s hypothetical contains limitations that are mild in nature or that only slightly interfere with work activity, that is not a good sign. Finally, you should be aware that every #disability judge has his/her own style when it comes to hypothetical questions. Some judges ask 5 or more questions with an increasing level of impairment with each question, whereas other judges only ask one or two.
