However, the investigating office deems the accusation untenable and rules in favor of a "request for dismissal." What should you do to prevent your complaint from ending up in a dusty archive, where it lingers forever? Well, the Public Prosecutor has deemed your complaint untenable at trial and, therefore, has ruled in favor of a request for dismissal. What do you do? You could either give up and give up, or... contest what the prosecutor says. In fact, the Public Prosecutor will have to explain the reasons why he requested dismissal. In the previous video—titled HOW TO WRITE A COMPLAINT—we mentioned that your complaint must include an important sacramental formula, namely, that you be informed in the event of a REQUEST FOR CLOSING THE CASE FROM THE INVESTIGATING OFFICE. If you haven't done so, I'm sorry, but you won't be informed of this decision by the Public Prosecutor, and therefore, if the GIP decides to close your complaint, it will be forgotten forever. On the other hand, if you mentioned this sacramental formula, you will be notified that the Public Prosecutor intends to close the case. Therefore, you will need to go to the Public Prosecutor's office to obtain a copy of the REQUEST FOR CLOSING THE CASE, which contains the reasons for the Investigating Office's decision. After that, through your trusted attorney, if you don't agree with the Public Prosecutor's reasons, you can... OBJECT. The notice of opposition to the request for dismissal is a written document, drafted by your defense attorney, in which you must criticize the investigations conducted by the Public Prosecutor's Office with territorial jurisdiction. But that's not all. Please note: in the notice of opposition, your defense attorney must not only address the flawed and superficial investigations conducted by the Public Prosecutor's Office, but must also indicate, under penalty of inadmissibility, which additional investigations need to be conducted. For example, we must indicate the names of John, Dick, and Harry as persons with knowledge of the facts who must be interviewed by the Public Prosecutor so that the truth of the facts can be ascertained and the perpetrator of the crime can be charged. Once the document is drafted, it must be filed with the competent GIP (Preliminary Investigations Judge). Please note: the objection to the dismissal request must be submitted, under penalty of inadmissibility, no later than 20 days after notification of the dismissal request. After that, a hearing will be scheduled before the investigating judge (GIP), where your defense attorney will present your case, convincing the judge to continue the investigation or, alternatively, to directly file a forced indictment. The floor will then be given to the judge, who will decide whether to: Dismiss the case.
