Minister Dias Toffoli presented a vote, supported by Minister Edson Fachin, with relevant positions within the discussion that could define the future of thousands of "Lifetime Review" cases in Brazil. And this completely changes the scenario that many were considering "closed." ⚖️ What many people still don't understand is that: ADI 2111 and Topic 1102 are NOT the same thing. ADI discusses the constitutionality of the rule in the abstract. Topic 1102, on the other hand, is the legal thesis of the "Lifetime Review" in diffuse control, that is: it is the paradigm process that directly discusses the rights of retirees in concrete cases. Therefore, abandoning the proceedings of Topic 1102 now could be a very serious mistake.
