Document Checklist for I-485 Under the New Policy Rules Memo

In this guide video, we go over a sample adjustment of status RFE and explain a practical checklist of positive factors and supporting documents that may help strengthen an adjustment of status filing or RFE response in view of the new 2026 USCIS policy memo affecting I-485 applications. The checklist includes evidence of family ties in the United States, long-term residence, employment history, education, tax compliance, property or business ties, community service, rehabilitation if there is a criminal record, hardship to family members, and a detailed personal declaration explaining why adjustment of status is appropriate. We also discuss examples of documents that may support these factors, including birth certificates, affidavits from relatives, I-94 history, approval notices, pay stubs, employment verification letters, tax returns, lease or property records, and community service letters. If you are planning to file adjustment of status, or if you already received an RFE asking for evidence of positive discretionary factors, this checklist can help you understand what USCIS may be looking for and how to organize your response.
