Many non-U.S. companies and individuals sell products and services in the U.S. Under what circumstances do you need to complete Form W-8ECI and pay taxes to the IRS? If a company sells products or services inside the U.S. it should consider the following: 1. Does the foreign corporation have a U.S. office or fixed place of business in the U.S.? IRC Section 865(e)(2) 2. Does the foreign corporation have income from the sale of inventory property through that U.S. office? 3. Is the inventory being sold to customers who are physically present within the U.S.?
