In fact, he performed the greatest and best magic trick ever seen: hiding the truth. Alleged crimes observed by Barbieri: Brazilian legislation: 1) Law No. 7,716, of January 5, 1989, amended by Law No. 9,459, of May 15, 1997, considers the practice of discrimination or prejudice against religions a crime. 2) Article 208 of the Penal Code - To publicly ridicule someone because of their religious belief or function; to impede or disturb a religious ceremony or practice; to publicly vilify an act or object of religious worship: Penalty - detention, from one month to one year, or a fine. 3) The Federal Constitution, in Article 5, VI, stipulates that freedom of conscience and belief is inviolable, ensuring the free exercise of religious worship and guaranteeing, in accordance with the law, the protection of places of worship and their liturgies. 4) Law 17.346/21 regulates the constitutional principle of the free exercise of the right to belief in the territory of São Paulo and establishes fines of up to R$ 87,000 for proven cases of disturbance of religious ceremonies and worship, vandalism of sacred symbols, and discrimination in schools, such as the use of religious attire. Persecution Art. 147-A. To pursue someone repeatedly and by any means, threatening their physical or psychological integrity, restricting their ability to move freely, or in any way invading or disturbing their sphere of freedom or privacy. Penalty – imprisonment, from 6 (six) months to 2 (two) years, and a fine. In addition to the crimes against my honor imputed by you: 1) Slander - falsely attributing a crime. 2) Defamation - attributing a negative fact that is not a crime. 3) Insult - attributing negative words or qualities, cursing. Cyberbullying The new law added Article 146-A to the Penal Code, defining bullying as systematic intimidation, whether individual or in a group, "through physical or psychological violence, against one or more people, intentionally and repeatedly, without evident motivation, through acts of intimidation, humiliation, or discrimination, or verbal, moral, sexual, social, psychological, physical, material, or virtual actions," and providing for a fine if the conduct does not constitute a more serious crime. In addition, the new law criminalized the virtual version of this systematic intimidation, called cyberbullying, when promoted in any digital environment. In this case, the penalty applied is two to four years of imprisonment and a fine, if the conduct does not constitute a more serious crime.
