Following a statement by a United Nations (UN) working group on the legal situation of Pedro Castillo, criminal lawyer Julio Rodríguez analyzed the former president's legal outlook and the possibility of him receiving a pardon. During an interview on Buenos Días Perú, Rodríguez maintained that the legal proceedings against Castillo Terrones, currently incarcerated in the Barbadillo prison, have been conducted within the framework of Peruvian law. He further explained that Castillo's continued imprisonment is due to decisions made by the judicial authorities. The specialist indicated that the necessary legal conditions for granting a pardon to Pedro Castillo do not currently exist, as the sentence imposed against him is still under appeal and has not yet become final. “The Minister of Justice has stated that there is no formal possibility of granting a pardon under Castillo’s current circumstances. He is imprisoned because his first conviction is under appeal; therefore, until it is final, a pardon is impossible. Granting a pardon to someone in these conditions is arbitrary,” he stated. Rodríguez also addressed the statement issued by the UN working group on Pedro Castillo and asserted that the document is not binding on the Peruvian State nor does it obligate the authorities to modify the decisions made in the process. “It is not binding on the Peruvian State. Using it in a judicial proceeding makes no sense whatsoever,” the criminal lawyer affirmed, commenting on the potential effects of the international document.
