Lecture delivered on April 11, 2024 Lecture 3. Vindicatory Claim (Part 2). Defense of a Bona Fide Purchaser. Questions: 1. History and conceptual foundations of defense of a bona fide purchaser. 2. Good faith of the purchaser. 3. The compensability of acquisition. 4. The nature of the property's removal from the owner's possession. 5. Commentary on the Dubovets case and paragraph 4 of Article 302 of the Civil Code of the Russian Federation. During the lecture, I referred to this case as the "Volkov case"—my mistake. The Volkov case is about acquisitive prescription. This case was based on a complaint filed by citizen Dubovets. I didn’t have time and this year I won’t be able to talk about the question of the consequences of a bona fide acquisition (but I more or less cover it in general lectures on civil law), as well as about calculations in vindication - I just showed Petrazhitsky’s book to the students.
