GPS Expert Testifies Pino's Boat Accelerated to 47 MPH Straight Into Marker 15 | Pt 20

Forty-three miles an hour, then forty-seven, and in nine seconds the boat never turned. The state's GPS expert pulled it off Pino's own device. Paul Alber spent decades on the water before he ever stepped into a courtroom. He came up through Florida's marine patrol, ran boats from the Keys to the Bahamas, and he wrote the GPS forensics course that law enforcement agencies across the country still use. The state brought him in as its most credentialed witness in the case against George Pino, the Miami real estate broker whose boat struck a channel marker on Biscayne Bay in September 2022 and killed seventeen-year-old Lucy Fernandez. Alber is here to do one thing: take the data off Pino's own navigation system and show the jury what the boat did in its final seconds. Watch what the defense does with all of it. They cannot argue the boat missed the marker, so they go at everything around the data: the evening sun off the right side of the boat, the seven teenagers seated up in the bow who could have blocked the view, and a tide number in Alber's own report that turns out to be wrong. Their whole theory is that this was a man who never saw what was in front of him. The data says where the boat went. The fight is over what the operator could see. Here is why this witness matters. The state never tested George Pino for impairment the night of the crash. With no test, the felony charges ride on proving he operated the boat recklessly, and the cleanest piece of that proof is this nine-second window. If the jury sees a man who drove straight into a marker he knew was there, the state has its recklessness. If they see a man who simply did not see it, the defense has an accident. --- WATCH WITH JUSTICE 0:00 to 48:18 - Alber lays out his credentials and the four rules of the road, then the judge stops him cold: breaking a boating rule is not, by itself, a crime. Then the wreck, the diagonal gash down the starboard side and the force it took to fold the bow up into the sign. 48:18 to 1:25:21 - Alber saves the waterlogged GPS, then pulls Pino's whole day off it. 1,889 points, the run to Elliott Key, the turn back south, and the historical tracks showing he ran these same waters over and over. 1:25:21 to 1:35:02 - The nine seconds. Forty-three miles an hour, then forty-seven, no track point in between, no course change. A straight line into Marker 15 across two football fields, the marker visible the whole way. 1:35:02 to 2:17:53 - Alber closes the doors the defense wanted open. The wild speed spikes in the raw data are rounding artifacts, not real speed. Then the on-water recreation, buoys on the exact coordinates, cameras everywhere, the synchronized footage played for the jury. 2:18:19 to 2:36:11 - The cross opens the accident theory. The evening sun off the starboard side Alber never analyzed, his admission that at six-foot-eight his own view was worse and a shorter operator could see better, and the seven passengers in the bow who could block the view. 2:36:11 to 3:20:56 - The two hardest hits. The tide number in Alber's own report that turns out to be wrong, and the base map showing the boat's track running west of the marker it indisputably struck on its right side. 3:26:37 to 3:39:55 - The redirect. The state rebuilds: the marker was visible for nine-plus seconds, not seeing it does not mean it was not there, and the zoomed-out chart shows the path running straight into Marker 15. --- COMPLETE CASE COVERAGE justiceisaprocess.com SUBSCRIBE for daily trial coverage and hit the notification bell so you never miss testimony.
