Alternating custody came to us from the West and is gaining increasing popularity. Although Polish lawmakers treat it somewhat with neglect and it is not described in detail in the Family and Guardianship Code, there is no doubt that it has become a permanent presence in Poland. What is alternating custody? Alternating custody occurs when a child alternates between living with their mother and father at repeated intervals. Formally, a child must have one permanent residence, as stipulated in the Civil Code. In practice, however, the child changes residence periodically. These periods don't have to be weekly – they can last 10 days, two weeks, or another period agreed upon by the parents. It's important that they are equal for both parents. In some countries, courts prefer joint custody. In Poland, it's still an exception to the rule. Research shows that it's preferred by people with higher education, a good financial situation, and more often by urban dwellers than rural residents. Currently, the standard in Poland is for the child to live with the mother. When does the court rule on joint custody? The court can rule on joint custody primarily if both parents request it and are willing to exercise it. Good communication between the parents regarding the child is crucial. Conflict between them precludes the possibility of ruling on this form of custody. There have been cases where joint custody was ordered against the wishes of one parent, but such decisions are controversial. If one parent does not consent to joint custody and the other is pushing for it, it is worth requesting an opinion from the Court Specialist Advisory Team (OZSS). These experts will assess the parenting competencies of both parties and determine whether such an arrangement is beneficial for the child in a given case. In the case of a mutually agreed-upon joint custody request, the court often requires a written agreement regarding the exercise of parental authority and maintaining contact with the child after the divorce. While this is not a necessary requirement, it helps the court ensure the parents are willing to cooperate. Parenting Agreement A parenting agreement is a document in which the parents outline the most important aspects of the child's upbringing. In the case of joint custody, it is advisable to address issues such as: 📌 Incurring unplanned costs 📌 Rules for exchanging dates in special cases 📌 Raising the child in a specific religion 📌 Rules for meetings with other relatives 📌 Methods of informing each other about important events in the child's life Although the agreement is not fully enforceable in the future, it is worth concluding it for clarity and a shared understanding of the arrangements. What does the court consider when ruling on joint custody? The court pays attention to: 📌 Proximity of the parents' residence – this simplifies logistics and minimizes stress for the child. 📌 Creating a parenting plan – demonstrates the parents' willingness to cooperate. 📌 A shared parenting approach – consistent values and principles between both parents. 📌 Openness to the child's needs – the child's well-being is the priority. 📌 The child's age – younger children may adapt better to changes. 📌 The child's opinion – in the case of older children, the court may listen to their opinion. Advantages and disadvantages of joint custody Advantages: 📌 It allows the child to maintain a strong relationship with both parents. 📌 The child learns from both parents. 📌 It prevents feelings of abandonment by one parent. 📌 It encourages greater involvement by a parent who was previously less present. Disadvantages: 📌 It can be difficult for the child due to constant changes in location. 📌 It requires a high level of communication and cooperation between parents. 📌 There is a risk that parents will be guided by their own needs rather than the child's best interests. 📌 It can cause feelings of insecurity or anxiety in vulnerable children. 00:00 Introduction 00:57 Joint custody – what is it? 02:02 When does the court rule on joint custody? 03:57 Parenting Agreement 05:03 What does the court consider when ruling on joint custody? 06:14 Pros and cons of joint custody 07:53 Joint custody – dirty tricks 10:19 Can joint custody be abandoned? 12:08 Nest custody Do you have any questions? | Call me 📞 695 560 425 Email me 💬 [email protected] CONTACT: https://rozwod-i-podzial-majatku.pl/ Divorce Law Firm - Divorce and Division of Property Wrocław Address: ul.
