OBLICON LECTURE: NATURE AND EFFECT OF OBLIGATIONS PART 2 (ART. 1164-1166 OF THE NEW CIVIL CODE)

Having acquired the basic knowledge of the general provisions pertaining to obligations as discussed in the previous module, the next step to the better understanding of the subject is to discuss the nature and effects of obligations. This module covers Articles 1163-1178 of the New Civil Code of the Philippines which include, among others: (a) the duties of the debtor and the remedies available to the creditor in either personal or real obligation; (b)the effects of legal delay in the performance of an obligation; (c) the grounds for liability for damages such as fraud, negligence, delay, and contravention of the terms of the obligation as provided under Article 1170; (d)the requisites and the rule as to liability in case of fortuitous events; (e)presumptions; and (f) transmissibility of rights. The students are expected to prepare for an in-depth study of the topics covered under this module so as to enlighten them of the discussions in the succeeding modules.
