O que é ser jusnaturalista (direito natural)?

This is how the word is used in the expression “natural law”. The expression “‘natural’ can be used to mean that some of these criteria or standards are somehow pre-normative to all human choices. In this conception, these pre-normative standards are not the product of any individual or collective choice or postulation, and cannot be revoked, however much they may be violated, challenged, or ignored. The idea is that recognizing these patterns in someone's deliberations is part of what it means to be reasonable [...]” (John Finnis in “A grand tour of legal theory”, Collected Essays IV, Philosophy of Law) Interesting? Law, which must be just, is a condition for our fulfillment in community. And challenging that: 1. There are no objective ethical values and everyone can do whatever they want. 2. Description: The book is a didactic introduction to John Finnis's theory of natural law. The text addresses the relationship between natural law, justice, and natural rights. John Finnis is a professor at Oxford University and the leading advocate of the New School of Natural Law. His Natural law theory proposes a contemporary version of the philosophies of Plato, Aristotle, and Thomas Aquinas. As a distinguishing feature, the work presents the latest version of the list of basic human goods and the supreme principle of morality defended by Finnis in the 2nd Edition of Natural Law and Natural Rights (2011). These are fundamental concepts for a full understanding of what natural law is, and are still little explored in Brazil. Summary 1 Justice, natural law, and natural rights 2 What is natural law? 3 Basic human goods 4 Requirements of practical reasonableness 5 The supreme principle of morality #NaturalLaw #NaturalLawTheory
