During the night, our client was stopped by the police for causing a traffic accident that resulted in minor damage to another legally parked vehicle. He was immediately subjected to a breathalyzer test by the police, which yielded a positive result, with a blood alcohol level of 1.88 g/l at the first test and 2.04 g/l at the second test. In this case, therefore, given the clear evidence that our client had driven his vehicle while intoxicated at night, he was charged with violating Article 186 of the Highway Code, aggravated pursuant to paragraph 2-sexies, as the crime was committed after 10:00 PM and before 7:00 AM. Furthermore, our client was charged with the aggravating circumstance set forth in paragraph 2-bis of Article 186 of the Highway Code, since, by driving the vehicle under the influence of alcohol, he had also caused a traffic accident.
