Legal Positioning and Institutional Gap of Digital Assets: Professor Chen Chung-Yang With the rapid development of new types of digital assets such as cryptocurrencies, social media accounts, cloud data, online game accounts, and creator platforms, the current civil law system's classification of property rights, personality rights, and rights control is insufficient to address practical issues. The use of digital assets is closely related to daily life; some have high economic value, while others have become personal identifiers possessing personality rights. These characteristics pose challenges to inheritance and marital property distribution systems, including how to confirm the existence and scope of digital assets, legally acquire access rights, assess their value, and complete the transfer of rights while ensuring personal privacy and information security. This course focuses on the legal issues of digital assets in family law, analyzing legal issues related to inheritance, marital property distribution, enforcement procedures, and privacy protection. It also introduces how the US RUFADAA system replaces traditional rights-based thinking with "access and management rights," serving as an important reference for the development of Taiwan's legal system.
