Prosecutor Moldir Kanisova read the indictment, and the parties assessed it. As expected, the responses were diametrically opposed. Judge Kasymbekov then began determining the order of the main trial. Here, tensions increased even further: the state prosecutor proposed first hearing the hooliganism case involving defendants Matayev and Ramazanov, followed by the main case, under Article 274 of the Criminal Code of the Republic of Kazakhstan for dissemination of knowingly false information. The lawyers saw this as the prosecutor's desire to "close" the trial from the press and the public after the "hooliganism" case—a request that had already been made earlier in the day, but the judge "suspended" it. The judge suddenly scheduled the continuation of the trial for Tuesday, June 30, although it had been tentatively scheduled for July 7. Kaparova's lawyer, Aidana Nurkeeva, who was late for her flight to Astana, where she lives, asked the judge to at least allow her to participate online. But he rebuffed her request. Aidana then filed a recusal, the third since the trial began. Mr. Kasymbekov replied that recusals were no longer accepted. The reason turned out to be simple: he is the acting chairman of the Almaly Court and cannot consider his own recusal. Nevertheless, passions ran high.
