The Law of Torts: Nuisance (Lecture 9, LAWS11069)
A nuisance is an interference with the enjoyment of land. While there are various statutes that create liability for ‘statutory nuisance’, this lecture examines the two types of common law action: private nuisance and public nuisance. Private nuisance is concerned with protecting a person’s right to the quiet use and enjoyment of their possession of land from unreasonable interference. Public nuisance is concerned with the protection of public rights and continues to be a crime at common law. This lecture will consider both of these actions and associated remedies.
