THE MÁLAGA LOCAL POLICE CHARGES A DRIVER WITH RECKLESS DRIVING AND SERIOUS INJURIES DUE TO SERIOUS NEGLECT AFTER INVESTIGATING A VIDEO UPLOADED ON SOCIAL MEDIA The investigation, initiated in mid-April following the viewing of a video recording and photographs uploaded to social media, revealed, upon matching the data, that the accident occurred during the early hours of Monday to Tuesday, January 9, in the city of Málaga, in which the co-pilot was seriously injured. 10.05.2018 - Officers from the Accident and Report Investigation Group (GIAA) of the Málaga Local Police have conducted an exhaustive investigation that culminated in the reading of rights to a 25-year-old individual and resident of Málaga as the alleged perpetrator of two offenses against road safety, one for driving a passenger vehicle with manifest recklessness, putting the passenger car in a dangerous position. Specifically, he was found to be endangering his own life, that of his passenger, and that of other road users, and another for causing serious injuries to the passenger due to gross negligence. Reckless Driving It all began in mid-April after viewing a video and photographs uploaded to social media in which local police from the GIAA observed reckless driving, which appeared to end in a traffic accident. The driver of the car not only endangered his own life and that of his passenger, but also committed several traffic violations, passing intersections without respecting the right-of-way (STOP sign) and driving at a speed far exceeding the permitted speed, which could also have endangered the safety of other road users. Serious injuries due to gross negligence The police investigation led officers to learn that the person filming the video, who was a passenger in the passenger seat of the crashed vehicle, suffered serious injuries as a result of the accident, consisting of a subcapital fracture of the left humerus. Locating the accident and positive cross-referencing of data The next step was to scrutinize the video of the accident frame by frame along with the photographs, which led local police to pinpoint the exact location, confirming that it had occurred in the city of Málaga, specifically on Fernández Fermina Street. It consisted of a head-on collision when the front right corner of the car hit the wall of the former Málaga Provincial Prison. On the day of the events, officers, who were patrolling the area, observed the crashed vehicle and took the necessary steps to locate its driver, who told them that "a vehicle had crossed his path, causing him to swerve and crash into the sidewalk and facade of the prison," and that "he was traveling alone," but was unharmed, according to his statement. The local police took him to the GIAA (National Police Agency) for the appropriate breathalyzer test. The result was 0.36 milligrams per liter of exhaled air in the first test and 0.34 in the second. They proceeded to file an administrative complaint against him for driving under the influence of alcohol. Exhaustive police investigation After viewing the video uploaded to social media and learning of the serious injuries sustained by the co-pilot, the GIAA officers were able to determine that the driver concealed the truth about what had happened. They even verified, through the Málaga Provincial Service Directorate's 061 (National Police Service), that on the day of the incident, calls had been received from two mobile phone numbers reporting an accident with injuries. Four young people were traveling in the car, an Audi RS3 Sportback, two of whom got out just before the accident. The driver told the co-pilot, "Let's film you and me," and accelerated sharply. His passenger repeatedly told him to brake, fearing an immediate collision: "Antonio, brake, Antonio! Brake, Antonio, brake!"
