The Constitutional Court has unanimously upheld a Western Cape High Court ruling declaring key provisions of South Africa’s Refugees Act and related regulations unconstitutional. The judgment overturns restrictive 2020 amendments that allowed the Department of Home Affairs to exclude asylum seekers from the refugee status application process on administrative and procedural grounds.
