Kouri Richins State and Defense Go To War Over Key Evidence In Fiery Hearing

The judge just told the defense team this is high-stakes poker. They had thirty minutes to decide if they were calling the bluff. Day 13 of Kouri Richins' murder trial opened without the jury for a pre-trial hearing that turned into a full evidentiary war. Two fights. The first: whether the defense could show the jury a photo Eric sent Kouri the day before he died, a picture tied to GIF images the prosecution says prove she was celebrating his death. The second fight was bigger. The defense wanted to show the jury that investigators ignored a lead about Eric allegedly seeking fentanyl. The judge found a case that said they could do it, but the price would be devastating. Watch what happens when the judge comes back from a break with a case law citation nobody saw coming. And pay attention to the thirty minutes that followed, because Kouri Richins and her defense team had to make the biggest strategic decision of this trial. --- WATCH WITH JUSTICE 0:05 to 8:44 - The text message fight. The defense wants to introduce a photo Eric sent Kouri the day before he died. The state says the Cellebrite timestamps don't match. Watch the judge cut through the technical arguments and find the narrow path. 8:45 to 20:27 - Hearsay battle over the photograph itself. The state argues a gravel photo is a statement. The judge is not buying it. This section ends with Exhibit 340 admitted and the photo cleared for the jury. 20:28 to 41:21 - The real fight begins. The defense asks O'Driscoll to leave the courtroom and lays out four questions about David Norris, a man who claims Eric asked him for fentanyl. The judge shuts it down on foundation, but the defense keeps pushing. 42:11 to 59:14 - Everything changes. The judge returns with a case called McCull and tells both sides what opening this door actually costs. The state reveals what's waiting on the other side: recorded evidence of Kouri allegedly seeking fentanyl herself. This is the most important section. 59:15 to 1:07:19 - "This is high-stakes poker." The defense gets thirty minutes to confer with Kouri. They come back and fold. The jury will never hear any of it. --- FROM THE DESK OF JUSTICE: https://www.justiceisaprocess.com/des... CASE BACKGROUND REPORT: https://justiceisaprocess.com/ut-v-ri... šŸ“– CASE BACKGROUND On March 4, 2022, Kouri Richins called 911 from her Francis, Utah home at 3 a.m. Her husband Eric was unresponsive. Toxicology revealed five times the lethal dose of fentanyl. Eric had no history of drug use. Prosecutors allege Kouri had been taking money from Eric for years. They say she owed lenders more than $1.8 million and had opened nearly $2 million in life insurance on Eric without him knowing. Eric discovered the financial issues in 2020. He changed his will, created a trust naming his sister as trustee, and removed Kouri as beneficiary. One year after Eric's death, Kouri published a children's book about a father watching over his son from heaven. Four weeks later, she was arrested. The defense maintains her innocence. šŸ“‚ PLAYLISTS & RESOURCES 🌐 Website: https://justiceisaprocess.com ā–ŗ Full Trial Live Broadcasts:    • LIVEĀ BROADCAST:Ā UTĀ v.Ā KouriĀ RichinsĀ Ā  ā–ŗ No Breaks Edition:    • NOĀ BREAKSĀ EDITION:Ā UTĀ v.Ā KouriĀ RichinsĀ Ā  ā–ŗ Trial Analysis Podcast:    • PODCAST:Ā UTĀ v.Ā KouriĀ RichinsĀ Ā  ā–ŗ Key Moments Playlist:    • KEYĀ MOMENTSĀ ANDĀ TESTIMONY:Ā UTĀ v.Ā KouriĀ Ric...Ā Ā  ā–ŗ Subscribe for Daily Coverage: Ā Ā Ā /Ā @justiceisaprocessĀ Ā  āš–ļø ABOUT JUSTICE IS A PROCESS This channel continues the work of Steven M.
