Schrony i MDS od 2026 roku: co zmienia nowe prawo? Ekspert wyjaśnia przepisy dla budownictwa
New regulations regarding shelters, hiding places, and temporary shelters (MSD) come into force in Poland on January 1, 2026. The Act on Civil Protection and Civil Defense and the regulations of the Ministry of Interior and Administration issued thereunder impose new obligations on investors, designers, and developers – particularly in multi-family buildings, public buildings, and underground garages. In this episode of "Construction Zones," I speak with Franciszek Wołoch from the Institute of Protective Construction Association about the real implications of the new regulations: • the difference between a shelter, a hiding place, and MSD; • where protective structures will be mandatory; • what exactly does the requirement "design and construct underground floors in a way that allows for the organization of temporary shelters" mean? • what does the regulation on technical requirements for protective structures (structure, emergency exits, equipment, resistance to debris, fragments, radiation, and the effects of explosions) look like? We also clarify the information chaos surrounding so-called "protective structures." "Shelter Act 2026": • What obligations will definitely come into force in 2026? • Who does it apply to: multi-family buildings, public buildings, tunnels, and underground facilities? • What about single-family homes and residential protective structures? • What is happening with existing shelters – what is their actual usefulness after verification by the State Fire Service and building supervision? In this episode, you will learn, among other things: • What is a MDS (Place of Emergency Shelter) and why it is becoming crucial for new investments? • How to design underground garages and underground floors to meet legal requirements? • What categories of shelters (U1–U3) are included in the regulations and what this means for the structure, installations, ventilation, and materials? • Where are the biggest legal gaps today (the merger of the act with the Building Law, procedures by authorities, decisions on shelter categories). This conversation is for: • designers and constructors, • developers and investors, • building managers and cooperatives, • those responsible for planning the safety and resilience of cities. 👉 If you want to stay up to date with new regulations in construction, thermal modernization, and technical regulations, subscribe to the Construction Zone and leave a comment about which topics related to shelters and MDS we should discuss in future episodes.
