Therefore, we can observe that sentencing must follow the following steps (phases): 1st – Analysis of the judicial circumstances – Article 59 of the Penal Code. In this phase, the judge establishes the base sentence; 2nd – Analysis of the legal circumstances (aggravating factors – Articles 61 and 62 of the Penal Code and mitigating factors – Articles 65 and 66 of the Penal Code). In this phase, the judge establishes the intermediate or provisional sentence; 3rd – Analysis of the grounds for sentence reduction and increase. The judge establishes the final sentence.
