Kalinga @ Kushal v. State of Karnataka (2024), legal key notes: 1. Evidentiary Value of Extra-Judicial Confessions Nature of Evidence: An extra-judicial confession is considered a weak type of evidence and is generally used as a corroborative link to lend credibility to other evidence on record. Standard of Proof: The standard for proving such a confession is on the higher side, especially when the prosecution's entire case rests upon it. Admissibility Criteria: For a court to accept an extra-judicial confession, the prosecution must establish that it was indeed made, was voluntary, and the contents were true. Its acceptability depends on the trustworthiness of the witness and the circumstances in which it was given. Requirement for Corroboration: Unless it inspires absolute confidence, a conviction for murder should not ordinarily be based solely on an extra-judicial confession without clinching corroborative evidence. 2. Circumstantial Evidence and "Panchsheel" Principles Definition: Circumstantial evidence is used when there is an absence of direct evidence. Completion of Chain: To sustain a conviction, the prosecution must establish a complete chain of circumstances that is consistent only with the conclusion of the accused's guilt. Margin of Error: The margin of error in such cases is minimal because the court is drawing an inference of criminal liability, a task that must be approached with abundant caution. Inconsistencies: If the chain of circumstances is broken by material inconsistencies—such as doubts regarding the identity of a body or contradictions in arrest records—the test for circumstantial evidence fails. 3. Appellate Powers in Appeals Against Acquittal Two-Views Theory: If two reasonably possible views can be taken from the evidence, the appellate court must adopt the view favouring the accused. Reinforced Presumption of Innocence: Following an acquittal by a Trial Court, the presumption of innocence in favour of the accused is reinforced. Threshold for Reversal: A High Court may re-appreciate evidence, but it cannot reverse an acquittal merely because it holds a different opinion. To reverse, the High Court must find that the Trial Court's order was perverse, illegal, or failed to appreciate the evidence fully. 4. Reasonable Doubt vs. Minor Inconsistencies Distinction: While "trite law" suggests that minor inconsistencies should not result in acquittal, a reasonable doubt is a serious doubt that renders the possibility of guilt highly doubtful. Judicial Duty: The purpose of a criminal trial is to ensure the innocent are not punished and the guilty do not escape. However, if the prosecution fails to establish a coherent chain of circumstances, the acquittal is not "light-hearted" but legally necessary. 5. Reliability of Witnesses Interested Witnesses: The testimony of a primary witness (like a victim's father) can be fatal to the prosecution if their conduct is unnatural—such as failing to report crucial information to the police immediately. Stock Witnesses: Courts are hesitant to rely on "panch" (independent) witnesses who appear at the police station without a clear explanation, as they may be stock witnesses for the investigating officer. #SupremeCourtJudgment #IndianLaw #LawStudents #EvidenceLaw #CircumstantialEvidence #CourtCase #LegalAwareness #Advocate #IPC #BNS
