Houses that are never finished, Pix payments that disappear, contractors who vanish with advance payments. The usual framing is the unscrupulous scammer and the victim who should have been suspicious. But this interpretation misses the mark. There's a legal loophole that's been open since 2004 and has never been closed, guaranteeing the continuation of the scam, regardless of the perpetrator's character. In this video I show: Why custom construction reverses the logic of any other purchase: you pay before the product exists, and the risk of this interval is shifted to the least prepared buyer in the relationship. How the collapse of Encol in 1995 generated the law of segregated assets, a real protection that never came close to those who directly hire a small contractor. Why informality in the Brazilian construction industry has only grown (63% in 2012 to 67% in 2023) while legal protection has remained concentrated where organized capital can lobby. In the end, I show what can be done in practice to protect oneself in a direct contract, since this defense today needs to be built manually by the buyer themselves.
